By accessing or using Pixatt ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Service.

2. Description of Service

Pixatt is a desktop application that uses artificial intelligence to generate metadata (titles, descriptions, keywords) for stock photos and videos. The Service requires credits to perform AI-powered analysis.

3. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use this Service
• One account per person; sharing accounts is prohibited

4. Credits and Payments

Purchasing Credits

• Credits are purchased in packages through our website
• All prices are in USD unless otherwise stated
• Payment is processed securely via Stripe or PayPal

Credit Usage

• Each AI analysis consumes one (1) credit
• Credits do not expire
• Credits are non-transferable between accounts

5. Refund Policy

Due to the nature of digital services:

• Unused credits may be refunded within 14 days of purchase
• Partially used credit packages are not eligible for refunds

6. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes
• Attempt to reverse engineer or hack the software
• Share your account credentials with others
• Use automated systems to abuse the Service
• Process content that violates third-party rights
• Resell or redistribute credits

7. Intellectual Property

Our Property: The Pixatt software, website, branding, and AI systems are owned by Pixatt. You may not copy, modify, or distribute our software.

Your Content: You retain all rights to your images and videos. Metadata generated by our Service is yours to use freely.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free service
• Acceptance of metadata by stock agencies
• Specific results or outcomes
• Compatibility with all file formats

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXATT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits or revenue
• Loss of data
• Stock agency rejections

Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify Pixatt against claims arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

• You may close your account at any time
• We may suspend or terminate accounts for Terms violations
• Upon termination, unused credits are forfeited unless otherwise required by law

13. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance of new Terms.

14. Governing Law

These Terms are governed by applicable laws. Disputes shall be resolved in the appropriate courts.
